This position paper contains a series of conceptual proposals regarding the approach and structure of the draft National Action Plan (NAP) in the context of alignment with medium-term commitments in the negotiation process of accession to the European Union and the implementation of the Republic of Moldova – European Union Association Agreement (AA). The note will also take into account the need to ensure synergy with other national strategic planning documents and the rigors foreseen by Government Decision no. 386/2020 regarding the planning, development, approval, implementation, monitoring and, evaluation of public policy documents.

Limitations

The position paper does not represent an exhaustive analysis of the implementation measures included in the 33 sections of the draft Plan. All the implementation actions proposed in the Plan will be evaluated separately by the responsible authorities and interested parties.

The deetatization and restructuring of the economy, as well as the good governance of the sector of state-owned companies and public property as a whole, are key components of chapter 20 of the acquis communautaire (enterprise and industrial policy), but not of the PNAA 2023-2027. On 28.09.2023, the Ministry of Foreign Affairs and European Integration submitted to public consultations "the draft government decision on the approval of the National Action Plan for Accession to the European Union, for the years 2023-2027"  (PNAA). The draft plan was developed based on the recommendations of the Commission Analytical report on Moldova’s alignment with the EU acquis, published on February 2, 2023 . However, it should be mentioned, that the European Commission's Report was drawn up based on the answers of the Republic of Moldova to the EU accession questionnaire . The questionnaire completed by the authorities of the Republic of Moldova follows the chapter structure of the community acquis and measures the alignment of domestic legislation to the acquis. Section I letter "B" of chapter 20 of the questionnaire is dedicated to the privatization and restructuring of the national economy. The questions in this section assess the degree of restructuring of the economy and the quality of governance of the state-owned enterprises. Following the analysis of the responses to this chapter of the questionnaire, the European Commission emphasizes in its Report the need to "continue reforms and increase the attractiveness of the national economy, in particular, for foreign direct investments".

The need to reform the state-owned enterprises sector is also emphasized in the Commission Opinion on the Republic of Moldova’s application for membership of the European Union. According to the findings of the EU Commission expressed in the Opinion on the application for membership of the Republic of Moldova, the state-owned enterprises sector continues to suffer due to the lack of appropriate corporate governance practices, due to inefficiency, and austere oversight, which further undermines private sector investment and economy-wide competitiveness and poses major fiscal risks. In this regard, the Commission recommends prioritizing on the government's agenda the reform of the sector, in particular, the improvement of corporate governance of state-owned enterprises sector, the reorganization, privatization, and liquidation of state-owned companies that do not pass the triage criteria .

From July to September 2023, these 15 civil society organisations, beneficiaries of the "Civil Society for European Integration" project, participated in five thematic training sessions related to the monitoring and analysis of budget expenses.  The training sessions aimed at enhancing the organisations’ capacities to support and promote the alignment of budgetary priorities with the Europeanisation agenda at the national and local levels, as well as at increasing their involvement in the decision-making.

The training addressed the general concepts of civic participation in the budgetary process at both the local and central levels; fundamental tools for budget monitoring; the role of advocacy; aligning the budgetary process with the Europeanisation agenda; and defining, deciphering and monitoring budget expenses in the social, economic and justice sectors.

The training focused on both theoretical and practical aspects. Participants had the opportunity to practice how to use data analysis tools for budgetary expenditures alongside subject-matter experts, and to analyse case studies from both the central and local levels. All of this was designed to contribute to a better understanding of the presented topics.    

In their feedback and evaluation of the training sessions, participants highly appreciated the quality of the training (with an average rating of 4.6 out of 5). This indicates that the knowledge and skills acquired will be valuable and relevant for the current and future work of their organisations.    

Representatives of the 15 civil society organisations, local partners of the project, have gained the necessary expertise to become more actively involved in the budgetary process and collaborate with relevant stakeholders, including local and central authorities, to formulate and advocate for the needs of the community and its citizens. 

In the coming months, experts will mentor these organisations and will help them develop 30 analytical reports addressing the planning and execution of budget expenses in various areas, such as local and regional infrastructure projects and social services. They will provide concrete recommendations, promoting a transparent and efficient budgetary process, in line with the association agenda priorities. 

These training sessions were conducted as part of the "Civil Society for European Integration" project, funded by the European Union and co-financed by Friedrich Ebert Foundation. The project is implemented by Expert-Grup Independent Think Tank, as the main partner, in partnership with the Institute for European Policy and Reform, Institutum Virtutes Civilis NGO (IVC), and Friedrich Ebert Foundation, Moldova.
