Public Acquisitions in Moldova: Problems and Solutions

In modern economies, more and more goods and services are purchased by government from the private market. Losses arising from procurement seriously affect infrastructure development and public services, leading to deterioration of the business environment and affecting standards of life. At the same time, public procurement procedures represent a productive environment for the manifestation of corruption. However, public procurement can not be seen as an area that is not influenced by the multitude of social, administrative and legal relations within the society. Thus, achieving high performance in procurement can only be made by improving procurement procedures.

The purpose of this study is to present the situation in public procurement in Moldova, not only through policies and regulations in this area, but also taking into account other factors that may influence their performance.

The study results are based on analysis of public procurement legislation, consultation of public authorities' web pages, international organizations, including donors and the international practices in this field. As sources of information, there were used actual process of procurement and performance audit reports by the Court of Auditors for the period 2011-2013 (60 reports), reports from the contracting authorities and appeals submitted by Public Procurement Agency at the request of authors and reports published on http://tender.gov.md/. Also, 30 local authorities of First and Second level were interviewed in order to assess the collaboration of  the Agency with the local public authorities.
