Why is it Necessary for Judges to Motivate their Legal Decisions?

Working on the National Human Development Report 2012 which was commissioned by the United Nations Development Program in Moldova we have pointed out to the crucial role of judiciary in the process of European integration of the Republic of Moldova. An efficient justice system also supports the capacity of national entrepreneurs to reap the gains from an eventual commercial and political integration of the country with the EU. It is in this context that we offer a short analysis of the Supreme Court of Justice President's proposal to eliminate the obligation for first level justices to motivate their decisions. It has indeed many implications on justices' accountability vis a vis their principal - namely the citizens.
