It is impossible to ensure a competitive and equitable business environment without having in place a functional regulation promoting fair competition. However, the concept of the ‘fair competition’ is quite elusive, this is why it is often difficult to assess if some competition practices are or not acceptable. In this brief piece of analysis we try to assess how helpful will be the proposed Competition Law for the National Agency for Competition Promotion to effectively promote fair competition in the Moldovan economy, without imposing excessive constraints on the businesses.
